Terms of Service — Stadium Thumbs

These Terms of Service ("Terms") govern your access to and use of Stadium Thumbs ("Stadium Thumbs", "we", "us", or "our") at https://thumbs.stadiumstream.co (the "Service"). By accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service. Please also read our Privacy Policy, which explains how we handle personal information.

Stadium Thumbs is part of Stadium. Sign-in, Stadium+, and Enhance token purchases are shared with other Stadium products, including Stadium Rumble. Those products may have additional terms, including on https://stadiumstream.co.

What Stadium Thumbs provides

Stadium Thumbs lets creators compose 16:9 thumbnails on a canvas, store faces and branding in a library, Enhance a composition with AI, and keep finished images in account history.

Enhance consumes tokens. Tokens can be purchased or granted with Stadium+ through Stadium Rumble billing. Token packs, prices, and the number of tokens needed for an Enhance are shown at checkout or in the product.

Eligibility

You must be old enough to form a binding contract where you live and have authority to accept these Terms. Creators must sign in with a valid Google account.

Creator accounts

Creators sign in using Google OAuth with basic profile scopes on this site. By using the Service, you authorise us to maintain your account, store your library and canvas data, and run Enhance on images you submit.

You are responsible for:

Maintaining the security of your Google account
Only uploading images and branding you have the right to use
Reviewing AI-enhanced output before you publish it
Complying with Stripe and other applicable third-party terms for token or Stadium+ purchases

Your content and AI Enhance

You retain ownership of images, branding, and other content you upload. You grant us the rights needed to host, process, display, and transmit that content through the Service, including sending compositions to our AI image generation provider to produce an Enhance.

AI-enhanced images are generated automatically and may differ from your canvas. We do not guarantee a particular style, likeness, or result. You are responsible for how you use output, including whether it infringes anyone else's rights or platform rules.

Token purchases and Stadium+ allotments are generally non-refundable except where required by law, including if you are unhappy with a particular Enhance.

Acceptable use

You may not:

Reverse engineer, scrape, or abuse the Service or its APIs
Interfere with security, authentication, or rate limits
Upload or generate unlawful, abusive, or infringing content
Upload images of other people without the rights or permission required
Impersonate others or misrepresent affiliation with Stadium or any creator
Circumvent token, Stadium+, or access controls

We may investigate violations and suspend or terminate access where appropriate.

Intellectual property

Stadium Thumbs and its software, branding, design, and documentation are owned by us or our licensors. We grant you a limited, non-exclusive, revocable licence to use the Service according to these Terms.

Third-party services

The Service integrates with third-party services such as Google, Stripe (via Stadium billing), hosting providers, and an AI image generation provider. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted operation, error-free performance, or that Enhance output will meet your requirements.

Limitation of liability

To the fullest extent permitted by law, Stadium Thumbs and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from or related to the Service or these Terms.

Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to us for the Service in the twelve months before the claim or (b) GBP £100, except where liability cannot be limited by applicable law.

Indemnification

You agree to indemnify and hold harmless Stadium Thumbs and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, Enhance output you publish, your breach of these Terms, or your violation of third-party rights or applicable law.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for us or others, or where required for operational, legal, or security reasons. Provisions that by nature should survive termination will continue to apply.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms where permitted by law.

Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Courts in England and Wales will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where mandatory consumer protection law in your country gives you the right to bring claims in your local courts.
